fa تعیین حق مالکیت در آثار تولیدی ناشی از هوش مصنوعی با نگاهی بر اقتصاد تجارت الکترونیک Determining the right of ownership in production works caused by artificial intelligence with a view on the economy of e-commerce عمومى General پژوهشي Research <div style="text-align: justify;">با پیشرفت سریع فناوری‌های هوش مصنوعی و افزایش استفاده از آنها در تولید محتوا و آثار خلاقانه، تعیین حق مالکیت در این آثار به یک موضوع مهم و چالش‌برانگیز تبدیل شده است. در این مقاله، به بررسی جنبه‌های قانونی، اقتصادی و اخلاقی تعیین حق مالکیت در آثار تولیدی ناشی از هوش مصنوعی پرداخته می‌شود و تأثیر آن بر اقتصاد تجارت الکترونیک مورد تحلیل قرار می‌گیرد. هدف از این پژوهش تعیین حق مالکیت در آثار تولیدی ناشی از هوش مصنوعی  با نگاهی بر اقتصاد تجارت الکترونیک مورد بررسی قرار گرفته است،بدین منظورتعیین و انتخاب شاخص ها با بهره گیری ادبیات تحقیق و مصاحبه اکتشافی به همراه نظر سنجی از  12 نفر از مدیران شرکت های تولید فناوری های اطلاعات کامپیوتری انجام شده است، از روش نمونهگیری هدفمند و با نمونهگیری نظری به اشباع نظری رسیده و سپس اطلاعات به دست آمده با استفاده از روش تحلیل مضمون مورد بررسی و مدل پاردایمی ساخته شده است که توسط نرم فزار Maxqda20 مورد تحلیل قرار گرفته است یافته های پژوهش نشان از انواع عوامل علی، پدیده محور، راهبردها، مداخله گر، زمینه ای و پیامدها بوده که با توجه به رویکرد تحقیق، مدل تحقیق در سطح ابعاد و مولفه های مورد بررسی و اعتبار سنجی در دو مرحله کمی و کیفی انجام پذیرفت.از آنجا که تجارت الکترونیک به شدت وابسته به تولید و توزیع محتوای دیجیتال است، تعیین صحیح حق مالکیت در آثار تولیدی توسط هوش مصنوعی می‌تواند نقش کلیدی در حفاظت از منافع اقتصادی بازیگران این حوزه داشته باشد. همچنین، عدم وضوح در قوانین مربوط به مالکیت می‌تواند به کاهش انگیزه برای نوآوری و سرمایه‌گذاری در فناوری‌های هوش مصنوعی منجرمی شود.  </div> <div style="text-align: justify;">With the rapid development of artificial intelligence technologies and their increased use in creating content and creative works, determining ownership rights in these works has become an important and challenging issue. In this article, the legal, economic and ethical aspects of the determination of ownership rights in the production works caused by artificial intelligence are investigated and its impact on the e-commerce economy is analyzed. The purpose of this research is to determine the ownership rights in the production works caused by artificial intelligence with a view on the e-commerce economy, in order to determine and select indicators by using the research literature and exploratory interviews along with a survey of 12 company managers. production of computer information technologies has been carried out, theoretical saturation has been reached from the purposeful sampling method and theoretical sampling, and then the obtained information has been created using the analysis method of the examined theme and a paradigm model which is made by the software Maxqda 20 has been analyzed, the findings of the research show a variety of causal factors, phenomenon-oriented, strategies, intervening, contextual and consequences, which according to the research approach, the research model at the level of dimensions and components investigated and validated in two Quantitative and qualitative stages were carried out. Since e-commerce is highly dependent on the production and distribution of digital content, the correct determination of ownership rights in production works by artificial intelligence can play a key role in protecting the economic interests of actors in this field.
