مشکلات بانکداری اسلامی در ایران با نگاهی به تجربه مالزی

<p dir="RTL"><em>گذشت</em> <em>چندین سال از تصویب و اجرای قانون عملیات بانکداری بدون</em> <em>ربا، فرصت</em> <em>مناسبی برای مطالعه و ارزیابی آن است. توجه کارشناسی در ابعاد نظری و اجرایی بانکداری بدون ربای ایران نشان میدهد خلاها و اشکالاتی وجود دارد که میتوان با اصلاح و تکمیل آنها، گامهای مؤثری در اصلاح ساختار نظام بانکی برداش</em><em>ت.</em> <em>یکی از اشکالات محوری که زمینه</em> <em>ساز اشکالات نظری و اجرایی فراوانی در عرصه ی بانکداری شده، تفکر جایگزینی یک به یک بانکداری بدون ربا با بانکداری متعارف ربوی است. اندیشهوران مسلمان از جمله طراحان بانکداری بدون ربای ایران، در صدد این بودند که الگوی جامع و واحدی طراحی کنند تا بتوانند جایگزین کامل بانکداری متعارف باشد و از این نکته ی اساسی غفلت کردهاند که اسلام با تحریم قرض ربوی، انواع معاملاتی را تأیید کرده که در قالب واحدی نمیگنجند و هر یک، مقتضای خود را دارند. روشن است که جمع کردن این معاملههای متنوع با احکام و ضوابط گوناگون در قالب سازمان مالی بهنام بانک، سبب پیچیده و مبهم شدن عملیات، صوری شدن قراردادها، بالا رفتن هزینههای نظارت و کنترل و سرانجام غیرکارا شدن نظام بانکی میشود.</em></p>
<p><em><span dir="RTL"> این مقاله نشان می دهد که نظام بانکداری در ایران دارای مشکلاتی است و آنگونه که انتظار می رفته نتوانسته ربا را از معاملات خود حذف کند. در این رابطه مقایسه­ای بین تجربیات ایران و کشور مالزی صورت گرفته است. این مقایسه نشان می­دهد که مشکلات فوق در بانکداری اسلامی مالزی هم وجود دارد. اما بدلیل وجود رقابت بین بانکهای اسلامی و متعارف ربوی و استفاده بیشتر از عقود اسلامی در بانکهای اسلامی مالزی، رضایت بیشتری از عملکرد بانکداری اسلامی در مالزی مشاهده می­شود</span></em></p>
<p>Over several years of the ratification and implementation of the law of without usury banking operations, is suitable opportunity for its analyzing and evaluation . Expert attention on theoretical and executive aspects of Iran's without usury banking shows that there are missing and problems which with amending and completing of them, steps of banking system structure may be reformed.</p>
<p>One of the axial problems of seeking the theoretical and executive problems in the sphere of banking is the thought of exact replacement of conventional banking with no usury banking. The Islamic researchers and those planners of no usury banking in Iran were seeking to plan the comprehensive and uniform pattern that can be the full alternative of conventional banking, but have neglected this fundamental point that Islam beside the forbidding of borrowing usury, has confirmed a variety of trading platforms that are not in the unit forms and each one has unique pattern. It is clear that the sum of the transactions with various rulings and conditions in the form of the financial organization in the name of the Bank, can cause complex and ambiguous operation, the false contracts, increasing the costs of supervision and control and finally non effective banking system.</p>
<p>This article shows that the banking system in Iran has problems and hasn't gone as expected in deleting usury from their transactions. In this regard the comparison between Iran and Malaysia experiences is fitted in. This comparison shows that is there above problems in regard of Islamic banking in Malaysia, too. But due to the existence of competition between Islamic and conventional banks and more use of Islamic contracts in Malaysia Islamic banks, there is more satisfaction from performance of Islamic banking in Malaysia.</p>
