Discount Credit- worthiness replacement for delay penalty in Iran's without Reba banking operations

Payment delays in repayment negative effects of the financial and economic imposes on banks, So that they may even put them on the verge of bankruptcy. Among the adverse economic effects can include decreased liquidity, lack of proper economic use of the assets of the bank and the damage caused by the devaluation noted. Following to solve this problem Council of Guardians adopted a solution as "delayed payment penalty" so that the banking system’s customers are required to repay their obligations in a timely manner, more than ever. However, most of the leading religious authorities and legal scholars do not agree with this approach. The article looking for introduction a fine alternative approach to a delay penalty in without Reba banking operations that is approved and agreed by all concerned authorities and scholars, and undermine its legitimacy is inserted. The article seeks to answer the question how and by what mechanism the discount Credit- worthiness can lead to timely payment of obligations by borrowers’ loans in the banking system? In this study used descriptive and analytical methods in determining and survey issues and Delphi method for empirical arguments. Hypothesis is that the discount Credit- worthiness is a proper alternative for bank’s claims delay penalty and also consistent with the clients' perspective and jurists. The results indicate that strategy discount Credit- worthiness with respect to the objectives penalty for delayed payment provide for bank and free of legal error, it is better to delay penalty and will be far better performance |
